Terms of Service

1. Introduction

Welcome to BookTranslate.ai. These Terms of Service ("Terms") govern your use of our website located at booktranslate.ai (the "Site") and the AI-powered translation services offered thereon (collectively, the "Service").

The Service is owned and operated by Táborszki Bálint EV, a sole proprietorship registered in Hungary with its principal place of business at 3300 Eger, Vécseyvölgy út 67., Hungary ("BookTranslate.ai", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access or use the Service. These Terms form a binding legal agreement between you and BookTranslate.ai.

If you are using the Service on behalf of an organization or entity ("Organization"), then you are agreeing to these Terms on behalf of that Organization, and you represent and warrant that you have the authority to bind the Organization to these Terms. In that case, "you" and "your" refer to you and that Organization.

2. Definitions

Service refers to the website booktranslate.ai and the AI-powered translation services, tools, and features provided by BookTranslate.ai.

User, you, or your refers to any individual or entity who accesses or uses our Service, whether as a guest or a registered user.

User Account or Account refers to the account you may create to access certain features of the Service.

User Content refers to any original text, documents, data, or other materials you submit, upload, or provide to the Service for translation.

Generated Translations refers to the translations produced by the Service from your User Content.

BookTranslate.ai IP refers to the Service itself, including its software, algorithms, design, text (excluding User Content and Generated Translations), graphics, logos, trademarks, features, and functionality.

3. Account Registration

To access certain features of the Service, including saving projects and managing translations, you may be required to register for a User Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You must be at least 18 years old or the age of legal majority in your jurisdiction to create an Account and use the paid features of our Service.

4. User Responsibilities and Acceptable Use

You are solely responsible for your User Content and your use of the Service. You agree not to use the Service to:

• Upload, translate, or share any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Upload, translate, or share any User Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party. You represent and warrant that you have all necessary rights, licenses, and permissions to submit your User Content to the Service and to authorize us to process it as described in these Terms.
• Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service.
• Attempt to reverse engineer, decompile, or otherwise try to extract the source code of the Service or any part thereof, except to the extent permitted by applicable law.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators, and reporting you to law enforcement authorities.

5. Privacy and Data Handling

Your privacy is important to us. Our Privacy Policy, which is incorporated by reference into these Terms, explains how we collect, use, store, and protect your personal information and User Content. By using our Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

User Content and Generated Translations are stored in your User Account to allow you to access and manage your projects. You can delete your projects, which will remove the associated User Content and Generated Translations from our active systems, subject to our data retention policies outlined in the Privacy Policy (e.g., for backups or legal compliance).

We do not use your User Content or Generated Translations for training our AI models without your explicit, separate consent.

If you are a business user processing personal data of third parties (e.g., your customers) through our Service, you are the "data controller" and we are the "data processor" under GDPR. In such cases, our Data Processing Addendum (DPA) will apply. Please contact us to obtain a copy of our DPA.

6. Payments, Billing, and Free Tier

6.1. Paid Services

Certain aspects of the Service require a one-time payment per translation. The cost of a translation is determined based on factors including the character count of your User Content, the number of processing passes selected, and potentially a surcharge based on paragraph density.

All applicable fees will be clearly disclosed to you before you commit to a payment. Prices are displayed in the currency indicated at the time of purchase.

As Táborszki Bálint EV operates under a VAT-exempt status in Hungary ("alanyi adómentes"), our prices do not include VAT, and VAT is not charged on our services. Consequently, the reverse-charge mechanism for VAT does not apply to transactions with business users in other EU countries. The price you see is the final price you pay.

By providing a payment method (e.g., via Stripe, our third-party payment processor), you authorize us (or our third-party payment processor) to charge you for the services you select. You are responsible for providing complete and accurate billing and contact information and for updating this information.

6.2. Free Tier

We offer a free tier for translations under a certain character limit (currently 3000 characters). Use of the free tier is subject to limits on the number of free translations per day and per week to ensure fair usage. These limits are subject to change and will be indicated within the Service. If your translation exceeds the free tier character limit or if you exceed the usage limits for free translations, you will be required to pay for the translation.

6.3. Refunds and Right of Withdrawal

Due to the nature of the digital service provided (instantaneous translation), payments for translations are generally non-refundable once the translation process has been initiated by you.

If you are a consumer in the European Union, you typically have a 14-day right to withdraw from online service contracts. However, for digital content or services that are fully performed immediately with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal, this right does not apply.

By proceeding with a payment for a translation, you explicitly consent to the immediate performance of the Service and acknowledge that you will lose your right of withdrawal from the contract once the service (translation generation) has begun.

Notwithstanding the above, we may consider refunds on a case-by-case basis in exceptional circumstances or as required by applicable law.

7. Intellectual Property

7.1. Our Intellectual Property (BookTranslate.ai IP)

The Service itself, including but not limited to its software, algorithms, design, text (excluding User Content and Generated Translations), graphics, logos, features, and functionality ("BookTranslate.ai IP") are and will remain the exclusive property of Táborszki Bálint EV and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7.2. Your User Content

You retain full ownership of all intellectual property rights in and to your User Content. We claim no ownership rights over your User Content.

7.3. Ownership of Generated Translations

You are the sole and exclusive owner of all rights, title, and interest in and to the Generated Translations produced by the Service from your User Content.BookTranslate.ai explicitly disclaims any ownership rights in the Generated Translations produced for you. You are free to use, modify, reproduce, publish, distribute, and otherwise exploit your Generated Translations for any lawful purpose, without any obligation or restriction from BookTranslate.ai, subject always to your ownership of, and rights in, the underlying User Content.

7.4. License to Us for Processing and Storage

To enable us to provide the Service, when you submit User Content for translation, you grant BookTranslate.ai a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, process, modify, and store your User Content and the Generated Translations solely for the purpose of:

• Generating the Generated Translations for you;
• Providing you with access to your User Content and Generated Translations within your User Account; and
• Operating, maintaining, and improving the Service (e.g., for technical support, troubleshooting, or system integrity, but not for training AI models as stated elsewhere).

This license continues as long as your User Content and Generated Translations are stored in your User Account. If you delete your User Content or Generated Translations from your account, or if your account is terminated, this license will terminate, except as may be necessary for us to comply with legal obligations, resolve disputes, enforce our agreements, or maintain system integrity (e.g., archival backups, which will not be used for any other purpose and will be deleted in accordance with our retention policies).

8. Termination

You may terminate your account and discontinue your use of the Service at any time by contacting us or using account deletion features if available.

We may suspend or terminate your account and bar access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in any activity that we, in our reasonable discretion, believe may harm the Service, other users, or third parties. We will generally endeavor to provide notice of such termination or suspension where feasible.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Upon termination, we may delete your User Content and Generated Translations in accordance with our data retention policies, as described in our Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOOKTRANSLATE.AI (TÁBORSZKI BÁLINT EV), NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING GENERATED TRANSLATIONS; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, IN ANY CIRCUMSTANCE, SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICES IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (EUR 100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS SHALL AFFECT ANY STATUTORY RIGHTS THAT YOU CANNOT WAIVE. IN PARTICULAR, NOTHING IN THESE TERMS SHALL LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY HUNGARIAN OR APPLICABLE EU LAW.

10. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

BOOKTRANSLATE.AI DOES NOT WARRANT THAT: A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE, INCLUDING THE GENERATED TRANSLATIONS, WILL MEET YOUR REQUIREMENTS, BE ACCURATE, COMPLETE, OR ERROR-FREE.

WHILE WE STRIVE FOR HIGH-QUALITY TRANSLATIONS, YOU ACKNOWLEDGE THAT AUTOMATED (AI-POWERED) TRANSLATION INHERENTLY HAS LIMITATIONS AND MAY NOT ALWAYS BE PERFECTLY ACCURATE OR NUANCED. THE GENERATED TRANSLATIONS ARE PROVIDED FOR YOUR USE, AND YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VERIFYING THEIR ACCURACY AND SUITABILITY FOR YOUR PURPOSES BEFORE ANY RELIANCE OR PUBLICATION.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

For any dispute you have with us, you agree to first contact us at hello@booktranslate.ai and attempt to resolve the dispute with us informally.

If you are a consumer residing in the European Union, you have the right to address any disputes with us through the EU Online Dispute Resolution (ODR) platform. You can access the ODR platform here: http://ec.europa.eu/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board unless legally required, but we will consider reasonable requests to do so.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice via email to your registered account and/or by posting a notice on our Site prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion, but will typically include changes to payment terms, liability, or significant alterations to your rights or our obligations.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

13. Third-Party Services

The Service relies on or may integrate with third-party services, such as AI model providers (e.g., Anthropic's Claude), database providers (e.g., Supabase), hosting services (e.g., Vercel), and payment processors (e.g., Stripe). While we select these providers carefully, we are not responsible for their operations, terms, or privacy practices. Your use of such third-party services may be subject to their respective terms and policies.

We may change our underlying AI model provider or other third-party services from time to time to enhance the Service. Such changes will be made with the aim of maintaining or improving service quality.
